This Privacy Policy provides information on how RIISE Shop (the "Site" or "we") collects and uses personal data when you visit or make a purchase from the Site.

RIISE is committed to protecting your privacy. RIISE is bound by the Privacy Act 1988 (Cth) (Privacy Act), which sets out a number of principles concerning the protection of your personal information known as the Australian Privacy Principles (APPs).

Using Personal Information

We use your personal Information to provide our services to you, which includes: offering products for sale, processing payments, shipping and fulfilment of your order, and keeping you up to date on new products, services, and offers.

Collecting Personal Information

When you visit RIISE Shop, we collect certain information about your name, contact details, delivery addresses, email address, birthday, your shopping or browsing behaviours, your device, your interaction with the Site and information necessary to process your purchases. We may also collect additional information if you contact us for customer support.

In this Privacy Policy, we refer to any information that can uniquely identify an individual (including the information below) as "Personal Information". See the list below for more information about what Personal Information we collect and why.

We share your Personal Information with service providers to help us provide our services and fulfil our contracts with you. For example:

•     We use Shopify to power our online store. You can read more about how Shopify uses your Personal Information here: https://www.shopify.com/legal/privacy.

•     We use Onspruce's "Cart Insights" app to record storefront cart activity on the Site, including the referring site, landing page, an approximate location derived from your IP address, and your browser and device details. If you are logged into your account, this app also links your cart activity to your customer account. We use this information to improve the accuracy of our reporting, to distinguish genuine visitor activity from search engine bot traffic, and to provide a chronological view of a customer's browsing, cart and checkout activity ("Customer Timeline") for customer service and analytics purposes. You can read more about how Onspruce handles this information here: https://onspruce.com/cart-insights-privacy-policy/.

•     We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

•     By using our website, you (the visitor) agree to allow third parties to process your IP address, in order to determine your location for the purpose of currency conversion. You also agree to have that currency stored in a session cookie in your browser (a temporary cookie which gets automatically removed when you close your browser). We do this in order for the selected currency to remain selected and consistent when browsing our website so that the prices can convert to your (the visitor) local currency. Separately, as described below, we also use your IP address to derive an approximate location for cart activity reporting and bot-detection purposes.

Device information

•     Examples of Personal Information collected: version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site.

•     Purpose of collection: to load the Site accurately for you, to perform analytics on Site usage to optimize our Site, and to distinguish genuine visitor activity from automated search engine bot traffic in our reporting.

•     Source of collection: Collected automatically when you access our Site using cookies, log files, web beacons and tags.

•     Disclosure for a business purpose: shared with our processors Shopify and Onspruce.

Cart activity information

•     Examples of Personal Information collected: referring site, landing page, an approximate location (city, region/state, and country) derived from your IP address, browser and device type, and, where you are logged in, your customer account details linked to your cart activity.

•     Purpose of collection: to record and report on storefront cart activity, to exclude search engine bot activity from our reporting, and to provide a chronological "Customer Timeline" of a customer's browsing, cart and checkout activity for customer service and reporting purposes.

•     Source of collection: collected automatically when you browse the Site or add items to your cart, using our Cart Insights app.

•     Disclosure for a business purpose: shared with our processor Onspruce (operator of the Cart Insights app), who may store and process this information outside Australia, including in Canada and the United States. See "Overseas Disclosure of Personal Information" below.

Order information

•     Examples of Personal Information collected: name, billing address, shipping address, payment information (including credit card numbers, Google and Apple Pay), location, device information, email address, and phone number.

We do not directly collect your credit card details to process your payment or for customer service purposes. Your credit card details are collected, processed and stored directly by our third-party payment processors pursuant to their terms of use and privacy policies. None of your credit card details are permanently stored with us. However, we may collect your bank account details to process refunds.

•     Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

•     Source of collection: collected from you.

•     Disclosure for a business purpose: shared with our processor Shopify, Marketplace facilitator, accounting software and customer service partner. Our Sellers will only receive order relevant information like: name, shipping address, payment status.

Minors

The Site is not intended for children under the age of 13, and we do not intentionally collect Personal Information from anyone under 13. In accordance with our Terms & Conditions, individuals aged 13 or older may create an Account, and individuals under 18 may only place an Order with the involvement of a parent or guardian. If you are a parent or guardian and believe your child under 13 has provided us with Personal Information, please contact us using the details in the Contact section below to request deletion.

Behavioural Advertising

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example:

We use Google Analytics to help us understand how our customers use the Site. You can read more about how Google uses your Personal Information here: https://policies.google.com/privacy?hl=en. You can also opt-out of Google Analytics here: https://tools.google.com/dlpage/gaoptout.

RIISE Shop also uses Remarketing with Google Analytics to advertise online; third-party vendors, including Google, may show RIISE ads on sites across the internet. RIISE and third-party vendors, including Google, use first-party Tracking Technologies (such as the Google Analytics cookie) and third-party Tracking Technologies (such as the DoubleClick cookie) together to inform, optimise, and serve ads based on visitors' past visits to RIISE, as well as report how ad impressions, other uses of ad services, and interactions with these ad impressions and ad services are related to visits to RIISE.

When you log on to the RIISE Shop website, RIISE with the help of Google Analytics may use your browsing behaviour to connect it with any other data that has previously been provided by you, in accordance with this policy. For more information about how targeted advertising works, you can visit the Network Advertising Initiative's ("NAI") educational page at https://www.networkadvertising.org/understanding-online-advertising/how-does-it-work.

You can opt out of targeted advertising by:

Additionally, you can opt out of some of these services by visiting the Digital Advertising Alliance's opt-out portal at: https://optout.aboutads.info/.

Lawful basis

Pursuant to the General Data Protection Regulation ("GDPR"), if you are a resident of the European Economic Area ("EEA"), we process your personal information under the following lawful bases:

•     Your consent;

•     The performance of the contract between you and the Site;

•     Compliance with our legal obligations;

•     To protect your vital interests;

•     To perform a task carried out in the public interest;

•     For our legitimate interests, which do not override your fundamental rights and freedoms.

Your Rights (EEA)

If you are located in the EEA, you have the right to: request access to the Personal Information we hold about you; request correction of inaccurate Personal Information; request erasure of your Personal Information; request restriction of our processing of your Personal Information; request portability of your Personal Information; and object to our processing of your Personal Information, including where we rely on legitimate interests. Where we rely on your consent, you may withdraw that consent at any time. To exercise any of these rights, please contact us using the details in the Contact section below. You also have the right to lodge a complaint with your local data protection authority.

Overseas Disclosure of Personal Information

Some of the service providers we use to operate the Site, including Shopify and Onspruce (Cart Insights), may store or process your Personal Information outside Australia, including in the United States and Canada, and other countries where those providers or their servers are located. By using our Site, you consent to this disclosure. While we take reasonable steps to ensure overseas recipients handle your Personal Information consistently with the Australian Privacy Principles, we may not always be able to ensure this, and to the extent permitted by law we are not accountable under the Privacy Act for an act or practice of an overseas recipient that breaches the APPs.

Retention

When you place an order through the Site, we will retain your Personal Information for our records unless and until you ask us to erase this information. To exercise your right of erasure, please contact us using the details in the Contact section below. Cart activity information collected via our Cart Insights app is automatically deleted after 62 days of inactivity.

Automatic decision-making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We DO NOT engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

•     Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.

•     Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.

The length of time that a cookie remains on your computer or mobile device depends on whether it is a "persistent" or "session" cookie. Session cookies last until you stop browsing and persistent cookies last until they expire or are deleted. Most of the cookies we use are persistent and will expire between 30 minutes and two years from the date they are downloaded to your device.

You can control and manage cookies in various ways. Please keep in mind that removing or blocking cookies can negatively impact your user experience and parts of our website may no longer be fully accessible.

Most browsers automatically accept cookies, but you can choose whether or not to accept cookies through your browser controls, often found in your browser's "Tools" or "Preferences" menu. For more information on how to modify your browser settings or how to block, manage or filter cookies can be found in your browser's help file or through such sites as www.allaboutcookies.org.

Additionally, please note that blocking cookies may not completely prevent how we share information with third parties such as our advertising partners. To exercise your rights or opt-out of certain uses of your information by these parties, please follow the instructions in the "Behavioural Advertising" section above.

Do Not Track

Please note that because there is no consistent industry understanding of how to respond to "Do Not Track" signals, we do not alter our data collection and usage practices when we detect such a signal from your browser. That said, you can still manage tracking through your browser's cookie settings and the opt-out tools described in the Cookies and Behavioural Advertising sections above.

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
